Teaching & Learning Strategies: |
Formal lectures will be supplemented by discussion and group work, based on simulated sports scenarios and case studies. The module will be supported by on-line learning materials with an emphasis on self-directed independent learning. |
Module Aim: |
The key aim of the module is to develop in learners an understanding of the organisational and legal frameworks, domestic and international, for the conduct of and participation in lawful sport. Learners will also be provided with the analytical tools necessary for determining the ethical implications of decisions made in a sporting context. |
Learning Outcomes |
On successful completion of this module the learner should be able to: |
LO1 |
Identify, differentiate and debate the organisational structures and appraise domestic and international governance issues for affiliated sporting bodies. |
LO2 |
Compare and contrast dispute resolution methods for sporting bodies and participants in sport. |
LO3 |
Outline and summarise the contemporary legal issues for sporting bodies and participants in sport in Ireland and internationally. |
LO4 |
Critically analyse and participate in a group activity/project on the manner in which participants in sport may respond to ethical issues in a sporting context and the factors which influence such responses. |

The Law and its Relationship with Sport
What is sport, historic evolution and Corinthian sense of fair play, when should the law intervene in sports, impact of professionalism, commercialisation and internationalization (5%)

Sports Governance
Legal/Organisational Structures and consequences, Governing Bodies- local, regional and international regulation, Codes of Practice - Principles v Rules debate (15%)

Adjudication - sports disputes
Natural and constitutional justice, Courts and Alternative Dispute Resolution in Sport in Ireland and Internationally- court system and dispute resolution authorities, governing legislation, Sporting Injunctions. (20%)

Introduction to contemporaneous legal lssues in Sport
Contract Law (formation, enforceability, terms and their interpretation, standard form contracts, restraint of trade, contract disputes). Employment Law (contracts, protective legislation, adjudicative bodies). Civil Liability in Sport – (negligence, duty and standard of care). Participator Violence in Sport (criminal offences and defences, consent, self –defence, provocation, playing culture, intervention of criminal law, role of referee, position of the ball) (30%)

Role of Ethics in Sport
Integrity, professional practice, competition and fair play, moral agency, ethics v regulation. Performance Enhancement – doping and drugs in sport. Child Protection issues in Sport (30%)
